1. About these terms

Vichats is a live chat service with AI replies for websites, run by an individual based in Indonesia ("Vichats", "we", "us"). These terms apply to everyone who creates a Vichats account and uses the dashboard, the chat widget or the direct chat link ("you"). By creating an account or using Vichats you agree to these terms. If you use Vichats for a business, you confirm that you are allowed to accept these terms for that business.

2. Beta service

Vichats is in beta. During the beta:

• the service is free of charge;
• features may change, be added or be removed at any time;
• the service may be interrupted for maintenance or fixes, sometimes without notice;
• we do not promise any particular uptime or response time.

If we ever introduce paid plans, we will tell you in advance, and nothing will be charged without your clear agreement.

3. Your account

• You must be at least 18 years old and give a real email address that you can access.
• New accounts are activated after the email address is confirmed. During the beta we may also review accounts before activating them, and we may decline an account without giving a reason.
• Keep your password safe. You are responsible for everything done with your account, including by team members you add.
• The Owner of an account decides who joins the team and what they can see. Remove team members who no longer need access.

4. Your website visitors

When you put Vichats on your website or share your direct chat link, you are the one offering the chat to your visitors. You are responsible for:

• telling your visitors, for example in your own privacy policy, that you use a live chat service and that their messages and technical details are stored and may be answered by an AI;
• having a valid reason under the law that applies to you to handle your visitors' personal data;
• what you and your team write in chats, and how you use the information visitors give you.

5. AI replies

Replies written by the AI are generated automatically from the instructions and information you give it. AI can be wrong, incomplete or out of date, even when it sounds confident. You are responsible for the instructions you give the AI and for checking that its answers suit your business. Do not let the AI make promises, give professional (for example medical, legal or financial) advice, or take decisions that should be made by a person.

If you connect your own AI provider or your own server (for example through AI Actions), messages and details are sent to that provider or server under your responsibility and that provider's own terms.

6. Acceptable use

You may not use Vichats to:

• break any law, or help someone else break one;
• send spam, scams, phishing or misleading messages, or pretend to be someone else;
• harass, threaten or abuse anyone, or share hateful, violent or sexual content involving minors;
• share malware or attack, overload, probe or try to get around the security of Vichats or anyone else's systems;
• collect payment card numbers, passwords or other highly sensitive data through the chat;
• copy, resell or rebuild the service, or access it in automated ways other than through the features we provide.

7. Your content

You keep all rights to the content you and your visitors put into Vichats (messages, images, AI instructions, shortcuts and settings). You give us permission to store, process and show that content only as needed to run the service for you. We do not sell your content and do not use your chats to train AI models.

8. Suspension and closing an account

You can stop using Vichats at any time and ask us to close your account. We may suspend or close an account, or remove content, if it breaks these terms, puts the service or other people at risk, or if we are required to by law. Where reasonable, we will warn you first. We may also end the beta or the service as a whole; if we do, we will try to give you notice so you can save your chat history.

9. No warranty

Vichats is provided "as is" and "as available", especially during the beta. We do our best to keep it running and your data safe, but we cannot promise that it will always be available, error-free or that no data will ever be lost. Keep your own copies of anything important.

10. Limitation of liability

As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost sales, lost data or damage to reputation, arising from your use of Vichats, from AI replies, or from the service being unavailable. Because the beta is free of charge, our total liability to you for any claim is limited to the amount you paid us for the service in the 12 months before the claim, which during the beta is zero. Nothing in these terms limits liability that cannot be limited by law.

11. Changes to these terms

We may update these terms as Vichats grows. The date at the top shows the latest version. If a change is important, we will tell account Owners by email or in the dashboard before it takes effect. If you keep using Vichats after a change takes effect, you accept the new terms.

12. Governing law

These terms are governed by the laws of the Republic of Indonesia. We will always try to solve a disagreement with you directly first. If that does not work, disputes will be handled by the competent courts of Indonesia.
